[Publib] Garcetti v. Ceballos: Decided

The news story of the day concerns the outcome of Garcetti v. Ceballos,  
commented upon earlier _here._ 
(http://librarydust.typepad.com/library_dust/2005/10/workplace_speec.html)   The  Associated Press reports that the Supreme Court 
has ruled in a 5-4 vote that  “The nation’s 20 million public employees do 
not have carte blanche free speech  rights to disclose government’s inner 
workings.” 
The ruling is in line with previous decisions of the court.  The ALA Council 
has dealt with this  issue in the form of a proposed Resolution, which has 
also been discussed in _this space_

Writing for the majority, Justice Anthony Kennedy noted,  
“Official communications have official consequences, creating a need for  
substantive consistency and clarity.  Supervisors must ensure that their employees
’ official communications are  accurate, demonstrate sound judgment, and 
promote the employer’s  mission.” 
He added that while government workers “retain the prospect of  
constitutional protection for their contributions to the civic discourse,” they  do not 
have “a right to perform their jobs as they see fit.”
