Well, as far as I’m told it’s not copies that are being made, it’s a question of access and a license that allows a person access, so it’s whatever the license reads. But this might be under dispute?

If the license agreement is silent about ILL, wouldn't Copyright law control the situation? I wouldn't think that you're barred from using online journals for ILL unless there is a license agreement that supercedes copyright law.
Not a lawyer, however....

I think that you have to a specific agreement in the license allowing you to copy from the electronic journal for ILL purposes. Otherwise you cannot use online journals for ILL. When buying or renewing an online database it's good to try and work these agreements in the license. No; I haven't been able to accomplish with our electronic resources personnel but I have brought it up!

It would be very nice to have an electronic resources management system
to handle this. We've found some publishers that we can lend from, but
it's not systemic or complete at all,

Subject: [ILL-L] Question about license agreements
Hello ILL colleagues,
We are trying to get a better handle on what our electronic journal
licenses allow regarding ILL. Some publishers allow electronic
transmission of articles, some do not. What do you do when the license
is silent regarding ILL? Currently we will print and mail the article.
Does anyone send it electronically when the license is silent?
We would appreciate your experiences in this matter.
Thanks!
