[ILL-L] Copyright question for phono-disks

Under section 108 (C) of US Copyright Law, libraries and archives are
allowed to migrate to another format if the original format is obsolete:
"(c) The right of reproduction under this section applies to three
copies or phonorecords of a published work duplicated solely for the
purpose of replacement of a copy or phonorecord that is damaged,
deteriorating, lost, or stolen, or if the existing format in which the
work is stored has become obsolete"

I am not familiar enough with US law, to know whether or not the
conditions of 108 (c) are being met in the situation described below.
