Hi Shedrick,
According to the information put together by the attorneys at Loyola, no recordings off cable can be used:
"Off-Air Recording of Cable TV Programs
Faculty may not record cable programming from providers such as HBO, The Disney Channel, ShowTime, C-Span, or ESPN. Permission must be obtained for educational purposes."

The 45-day rule only applies to things taped off broadcast TV.

Hi all,
This question doesn't directly involve Interlibrary Loan, but as ILL and copyright often cross paths, I thought I'd pick your collective brain...
I have an instructor wishing to place a videocassette of a movie he recorded off of cable on reserve to be used by his students. I've looked in my handy-dandy copyright primer and it seems to indicate that as this is a recording of an "off-air broadcast" then any use of the copy would need to be done within 45 days of the recording. This movie was made back in 2003...I do not know when it was recorded.
Am I right in this? Should this reserve be disallowed due to copyright concerns?
