Section 108, (d)  -- "The rights of reproduction and distribution under this section apply to a copy, made from the collection of a library or archives where the user makes his or her request or from that of another library or archives, of no more than one article or other contribution to a copyrighted collection or periodical issue"

We interpret this to mean we may request no more than one article for the same patron from the same issue.  

But we enforce that only in regards to what we can reasonably can know.  We decline to get second or third articles from the same issue when the requests are all submitted at one time.  But we don't verify through a search of records that we have never gotten an article for this patron from this issue.

 CONTU requires retention of records, but speaks only to requests for publication dates within the last five years. The copyright LAW doesn't speak to a requirement to maintain records of completed copies. (If any of you out there know this to not be true, please please point to the language to support it so I can rescind this statement and we can mend our ways).

So, we don't keep records of requests older than the 5 years mandated by CONTU.  Therefore we have no way to REASONABLY know if a patron is asking for more than one article from an issue older than 5 years unless he/she asks for them at the same time.

I really am leaning toward thinking that we can't borrow more than one
article from a single issue of any periodical, does anyone feel strongly
otherwise? Thanks,
