[ILL-L] copyright vs. fair use problem--help please.

Well geez, I thought people would jump on this one.  As far as I have
heard, it is unacceptable to use an ILL book in a Reserves collection.
The book has been borrowed with the understanding that it is for your
one customer.  The wear and tear on a book being used my many students
is just one issue.  It also increases the opportunity for the book to
become 'lost' and most loan periods are nowhere near a whole semester.
In most instances, we purchase books that are requested for Reserves and
that takes care of the copyright issue.

A faculty member has requested some short stories that we don't own to
be put on reserve. My dean wants me to get them via ILL. He thinks that
it would fall into fair use because we'd only do it once and only the
students in the class would access them.

I have two problems with this:
1. Since they are short stories it would be the ENTIRE work
2. I'm not sure we should ou them on reserve since we don't own them.

Therefore, I am asking the collective knowledge of this list. What are
your opinions on this? Is this an instance of fair use or not?

Please reply directly to me since I only get the digest and this is
somewhat time-sensitive.
