[ILL-L] responsibility for lost book

We had  situations with referral centers where we were having trouble
getting a response, let alone payment, for lost or damaged books and the
stonewalling by the borrower had been playing out over a year.  One of
the referral centers we dealt with was in-state; we explained the
situation to them and asked them not to refer any more requests from
that library to us.  The defaulting library in question finally paid up.
 
With our software, we can't block one site served by an OCLC symbol
without blocking them all.  We have a notes field for each site and also
temporarily add DON'T LEND in front of the defaulting library site's
name so we will know not to lend to that one while we lend to the
others. We use a conditional to indicate why we can't lend.  I wish
there was an easier -one click- way to handle this.

I run a regional ill center such as you describe.  Another term for what
we do is that we're an ILL processing center.  I recently wrote a little
article for ShareILL that explains ILL processing centers.  I also had
input from some colleagues who do the same thing.  Please feel free to
look at that article and edit, etc. in the wiki way.
 
To answer your question, though, I would prefer that you send the bill
to my library, the one that has the OCLC connection.  We will deal with
our member library until you are satisfied by payment or replacement or
return of the loaned item.  We appreciate it if you only partially block
us, but one of the threats we hold over some of our member libraries is
"if you don't get this item back, you are blocking borrowing services
for 41 towns."  Sometimes that gets action.  In the end, though, if
worse comes to worse and we cannot get satisfaction from our member
library, we, the processing center will make things good for you, the
lender.  As you said, we're the ones who initiated the loan, agreed to
the codes, etc.

Regional Library System assume any liability for lost or damaged
material?  If the Regional Library is the OCLC member  and LVIS member
etc, it seems they are the ones who have agreed to follow the guidelines
set forth by OCLC, LVIS etc. 

	  

	This question has come up because I need to bill a library that
uses a large regional provider to do their ordering. I'm sending the
bill to the library to which the book was shipped, but just wondered if
there might be any responsibility on the part of the Regional Library
System. 

	When I have to bill a library for non-returned material, I block
that library's OCLC code in my records so I don't send more books to
them until the problem is cleared. In this case, if I do that, the
entire region is blocked. I can, and will, add a notation so that only
that one library within the system is blocked, but this has me wondering
about the overall responsibility of the Regional Libraries.
