Dear Jon,
Do you hold our contracts, the contracts for Iona? Or are they done
through Waldo? Thanks, I'm trying to find out the wording of our
contracts, thanks, Ed.

Hi Jody,

I work for Nylink, a regional OCLC network. Thorough our Cooperative
Service Program, we negotiate consortial pricing with electronic content
providers. The standard language that we include in our contracts
includes the ability to fill ILL requests. The majority of content
providers have not changed the standard language, so permit ILL.

"Interlibrary Loan. Subscriber may fulfill requests from other
institutions, a practice commonly called Interlibrary Loan. Licensee
agrees to fulfill such requests in compliance with section 108 of the
United States Copyright Law (17 USC 108) and clause 3 of the Guidelines
for the proviso of subsection 108(g)(2) prepared by the National
Commission on New Technological Uses of Copyrighted Works."

I hope that this information helps. Please let me know if you have
questions.

Jon Penn

Since we are discussing E-Journal contracts, I was hoping once again to
ask the ILL community, if you have been doing anything different in
regards to the standard license agreement that comes with different
contracts related to ILL privileges? We are currently looking once
again at using a "standard ILL clause" that stipulates more clearly
what is and is not allowed directly with lending ILL articles from the
these databases.

If you can-- please share with me the verbiage that was deemed the most
successful in obtaining the rights to lend from your subscribed
e-journals. We look forward to the day, when these specific defined
clauses become standard practice and we don't have to negotiate them
quite so frequently.

Feel free to reply off-list if you think everyone has heard this too
many times before--I appreciate your time.

Happy Holidays,
